The July, 2011, Edition of the Zoning Regulations for the City of Kiowa, Kansas, prepared by the Kiowa City Planning Commission, is by reference adopted as fully as though set out at length herein as the Zoning Regulations for the City of Kiowa, Kansas. A copy of the zoning regulations, shall be filed with the city clerk to be open for inspection and available to the public at all reasonable business hours. Said regulations have been subsequently amended by Ordinance Nos. 419 and 447.

The July, 2011, Edition of the Subdivision Regulations for the City of Kiowa, Kansas, prepared by the Kiowa City Planning Commission, is by reference adopted as fully as though set out at length herein as the Subdivision Regulations for the City of Kiowa, Kansas. A copy of the subdivision regulations, shall be filed with the city clerk to be open for inspection and available to the public at all reasonable business hours.

(a)   For the purpose of wholly or partially defraying the costs of processing applications for actions taken under the Kiowa Zoning and Subdivision Regulations, there is hereby established a schedule of fees as follows:

(1)   Application for Rezoning or Conditional Use (no separate fee for Development Plan): $75.00.

(2)   Application for Development Plan Approval separate from Rezoning or Conditional Use application: $50.00.

(3)   Application for Variance or Special Exception: $100.00.

(4)   Application for Appeal to Board of Zoning Appeals: $25.00.

(5)   Application for Building Permit: $25.00 or 50.00 (as set in fee resolution).

(6)   Application for a Preliminary Plat: $50.00 plus $2.00 for each lot

(7)   Application for a Final Plat: $25.00 plus $2.00 for each lot.

(8)   Application for a Short Form Plat: $100.00.

(b)   All costs associated with recording documents, placing legal publications, and mailing notifications to adjoining landowners shall be payable in addition to the fees stated above. These will be separately billed to the applicant and must be paid prior to final disposition of the application.

(c)   No fee shall be refunded regardless of any decision or finding made regarding the request for action covered by said fee.

(d)   A written receipt shall be issued to the person(s) making payment of the fee.

(e)   No fee shall be required when a proposal concerns land owned by any Township, City, the County, the State, or the Federal Government; nor any agency, board, or legal entity thereof.
