CHAPTER I. ADMINISTRATIONCHAPTER I. ADMINISTRATION\ARTICLE 3. CITY ADMINISTRATOR

(a)   The office of the City Administrator was created and established on June 7, 1976.

(b)   The City Administrator, who shall be the chief executive officer of the city, shall be hired by the Mayor, by and with the consent of the City Council, and he or she shall serve at the pleasure of the council. He or she shall be a person of demonstrated administrative ability and shall be chosen solely on his or her executive and administrative qualifications and knowledge of accepted practices for this position.

(c)   The City Administrator must reside within the limits of the Kiowa Township.

(d)   The same person may hold the office of City Clerk and the office of City Administrator.

The City Administrator shall receive such compensation as may be determined from time to time by the governing body. He or she shall serve at the pleasure of the Council, provided that the Council may, by contract or otherwise, specify a specific term.

Except as otherwise provided by law or ordinances of the City of Kiowa, the City Administrator shall have the following powers, duties and responsibilities:

(a)   To manage, direct, control and supervise all the administrative departments and services of the city; including but not limited to the following departments: Administration, Police, Street, Fire, Park, Pool, Electric, Water, Wastewater, Solid Waste and City’s Special Recreation.

(b)   To manage, direct, supervise and assign the duties of all the appointed officers and employees, excluding the appointive offices of Municipal Judge and City Attorney who shall be responsive to the Mayor and Council;

(c)   To recommend to the Mayor and City Council suitable persons to be hired or appointed to carry out functions of the City and make recommendations for the termination of employment of employees when such action is deemed necessary and appropriate;

(d)   Serves as the Chief Financial Officer for the City as follows:

(1)   Prepares the annual operating and capital improvement budgets for governing body approval and keep such body fully, completely and timely advised as to the financial condition of the City;

(2)   Oversees budget expenditures, revenues and accounting and makes regular, written financial reports to the governing body.

(3)   Adjust, with governing body approval, expenditures and budget allocations as needed to maintain fiscal integrity;

(4)   Exercises general supervision and control over all City purchases and expenditures within budgetary limitations and such policies as may be established by the governing body.

(e)   Serves as Human Resources Management Officer as follows:

(1)   Conducts annual performance evaluations for department directors and assures all other employees receive an annual performance evaluation;

(2)   Recommends to the governing body a schedule of salaries for all officers and employees;

(3)   Recommends for governing body consideration and approval, revisions as needed in the City’s position classification pay plan, job descriptions and personnel policies;

(4)   Recommends purchasing policies to the governing body for approval.

(f)   Provides for the inventory, care and maintenance of all city-owned land, property, buildings and equipment;

(g)   To develop and prepare such planning, short-range as well as long-range, as the governing body shall request and shall submit such planning to the governing body for action;

(h)   To attend, unless excused, all meetings of the governing body and such other meetings of commissions and other organizations as the governing body shall designate and shall regularly report on the status of the city and its services to the governing body;

(i)    To make such recommendations and ordinances to the governing body as are deemed necessary and expedient to improve the health, safety or welfare of the city or to improve the effective administration of all city services;

(j)    To be responsible for the proper and efficient discharge of the duties of all city administrative officers and employees;

(k)   Assures that state and federal laws, and city ordinances and policies are enforced;

(l)    Serves as liaison to other governmental entities, businesses, and the news media as directed by the governing body;

(m)  Oversees the implementation of contracts, interlocal agreements, and other actions approved by the governing body;

(n)   To investigate affairs of the city under his or her supervision, or any franchise or contract for the proper performance of any obligation to the city within his or her jurisdiction;

(o)   Develops, in consultation with the governing body, the agendas for council meetings; prepares agenda packets and distributes them in advance of meetings; and provides written recommendations, as appropriate, on agenda items;

(p)   Researches public policy issues as requested by the governing body; and offers recommendations to the governing body

(q)   Except for the purpose of inquiry, the governing body and its members shall deal with the city staff solely through the City Administrator and neither the governing body nor any member shall give orders/directions to any employee of the city;

(r)    To perform such other duties as required by law or the governing body.

It shall be the general practice of the governing body to issue all orders and directives to all city officers and departments and receive reports and communications therefrom through the office of the City Administrator.
