The International Residential Code, 2015 Edition, including all appendix chapters is hereby incorporated by reference herein and made a part of the Code of the City of Kiowa, Kansas, save, and except such portion as are hereinafter or may hereafter be deleted or amended, as authorized and in the manner prescribed by the provisions of K.S.A. 12-3010.

(a)   Section R103 is hereby deleted in its entirety.

(b)   Section R 106.1.3 is hereby deleted in its entirety.

(c)   Section R106.3.1 is hereby deleted in its entirety.

(d)   Section 109.1.3 is hereby deleted in its entirety.

(e)   Section R317.1 subsection Exceptions: 2. is hereby deleted in its entirety.

(f)   Section R613.2 is hereby deleted in its entirety.

(g)   Section R801.3 is hereby deleted in its entirety.

(h)   Section E3802 is hereby deleted in its entirety.

Changes, additions, and deletions to sections of the International Residential Code, 2015 Edition and the appendices thereto are adopted only as set forth hereinafter:

(a)   101.1 TITLE. These regulations shall be known as the Residential Code of the City of Kiowa, hereinafter referred to as the “residential code,” the “I.R.C.”, or “this code.”

(b)   R104.6 RIGHT OF ENTRY. The Building Official shall have authority to enter upon premises at reasonable hours for the purpose of making inspections. Entry shall be made so as to cause the least possible inconvenience to any person in possession of the structure. If entry is denied, the Building Official may seek an order for this purpose from a court of competent jurisdiction.

(c)   Section 105 is hereby amended to read as follows:

R105.2 WORK EXEMPT FROM PERMIT. Subsection Building:

       1. One - story detached accessory structures used as tool and storage sheds, playhouses and similar uses, provided the floor area does exceed 100 square feet.

(d)   R112 BOARD OF APPEALS. In order to hear and decide appeals of orders, decisions or determinations made by the Building Official relative to the application and interpretation of this code, the City Governing Body is hereby authorized to act as Board of Appeals.

(e)   R113.4 VIOLATION PENALTIES. Persons who shall violate any provision of this code, or shall fail to comply with any of the requirements thereof, or who shall erect, install, alter or repair electrical work in violation of the approved construction documents or directive of the Building Official, or of a permit or certificate issued under the provisions of this code, shall be guilty of a misdemeanor, punishable by a fine of not more than $500.00 (five hundred) dollars, or by imprisonment not exceeding 30 (thirty) days, or both such fine and imprisonment. Each day a violation continues after due notice has been served shall be deemed a separate offense.

(f)   R114.2 UNLAWFUL CONTINUANCE. Any person who shall continue any work after having been served with a stop work order, except such work as that person was directed to perform to remove a violation of unsafe condition shall be liable for a fine of not less than $25.00 dollars, and not more than $100.00 dollars. Said fine shall be collected prior to re-inspection.

(g)   Section R303 shall be amended as follows:

(1)   R303.3 BATHROOMS. Bathrooms, water closet compartments and other similar rooms shall be provided with aggregate glazing area in windows of not less than 3 square feet (0.3 m2), one-half of which must be openable.

       Exception: The glazed areas shall not be required where artificial light and a mechanical ventilation system are provided. The minimum ventilation rates shall be 50 cubic feet per minute (24 L/s) for intermittent ventilation or 20 cubic feet per minute (10 L/s) for continuous ventilation. Ventilation air from the space shall be exhausted to the outside.

(2)   R303.6 STAIRWAY ILLUMINATION. All interior and exterior stairways shall be provided with a means to illuminate the stairs, including the landings and treads. Interior stairways shall be provided with an artificial light source located in the immediate vicinity of each landing of the stairway. Exterior stairways shall be provided with an artificial light source located in the immediate vicinity of the top landing of the stairway. Exterior stairways providing access to a basement from the outside grade level shall be provided with an artificial light source located in the immediate vicinity of the bottom landing of the stairway.

(h)   Section R311 shall be amended as follows:

R311.7.4.1 RISER HEIGHT. The maximum riser height shall be 8” (203 mm). The riser shall be measured vertically between leading edges of the adjacent treads. The greatest riser height within any flight of stairs shall not exceed the smallest by more than 3/8 inch (9.5 mm).

(i)    R319.1 ADDRESS NUMBERS. Buildings shall have approved address numbers, building numbers or approved building identification placed in a position that is plainly legible and visible from the street or road fronting the property. These numbers shall contrast with their background. Address numbers shall be Arabic numbers or alphabet letters. Numbers shall be a minimum of 4 inches (102 mm) high with a minimum stroke width of 0.5 inch (12.7 mm).

(j)    R802.10.1 TRUSS DESIGN DRAWINGS. Truss prints may be required by the Building Official for review prior to construction. Truss prints shall be available on the job site during inspections.

(k)   M1308.2 PROTECTION AGAINST PHYSICAL DAMAGE. In concealed locations where piping, other than cast - iron or galvanized steel, is installed through holes or notches in studs, joists, rafters or similar members less than 1.5 inches (38 mm) from the nearest edge of the member, the pipe shall be protected by shield plates. Protective shield plates shall be a minimum of 0.062 - inch - thick (1.6 mm) steel, shall cover the area of the pipe where the member is notched or bored.

(l)    M1501.1 OUTDOOR DISCHARGE. The air removed by every mechanical exhaust system shall be discharged to the outdoors. Air shall not be exhausted into a soffit, ridge vent or crawl space.

(m)  G2415.1 PROHIBITED LOCATIONS. Shall be amended by adding the following section:

Exception: Such piping may be installed through ventilated attic spaces with limited or no tenant access.

(n)   G2415.5 PROTECTION AGAINST PHYSICAL DAMAGE. In concealed locations, where piping other than black or galvanized steel is installed through holes or notches in wood studs, joists, rafters or similar members less than 1.5 inches (38 mm) from the nearest edge of the member, the pipe shall be protected by shield plates. Shield plates shall be a minimum of 1/16-inch thick (1.6 mm) steel, shall cover the area of the pipe where the member is notched or bored.

(o)   P2603.6.1 SEWER DEPTH. Building sewers that connect to private sewage disposal systems shall be a minimum of 12” inches (305 mm) below finished grade at the point of septic tank connection. Building sewers shall be a minimum of 12” inches (305 mm) below grade.

Not less than two (2) copies of the Residential Code incorporated by reference in Section 4-801 shall be filed with the City Clerk. Such copies shall be marked or stamped “Official Copy as Incorporated by Ordinance No. 438” with all sections or portions thereof intended to be omitted clearly marked to show any such omissions. Such copies shall have attached a copy of this article, and shall be open to inspection and available to the public during all reasonable business hours.

The Building Official shall have the authority to promulgate such rules and regulations as are necessary to carry out the purpose of the Residential Code as adopted in Section 4-801.
